Jemisin, The Fifth SeasonBreaking Earth, a collection of visual and written essays brought together for this special issue of SubStance, is a disruptive (...) engagement with concepts and terms that have become touchstones for the geologic/planetary turn in the inhumanities. The project took initial inspiration in conversations the co-editors had about N. K. Jemisin’s Broken Earth trilogy, in which geologic and human power interweave in complex webs among bodies born of chiasmic crossings of Anthro-progeny and Geo-orogeny. Conceived as a companion almanac to Jemisin’s trilogy—though references to that work are intentionally oblique—the volume pursues new ways of reading, and being with, the geos of this planet. In doing so, Breaking Earth seeks to reframe and deepen the discussions, both historical and philosophical, around the relationship between geology and humanity.The notion of the Anthropocene has, for several decades, monopolized said discussions. Since its articulation in the early 2000s, the concept has been equal parts galvanizing and problematic in thinking with the Earth (Crutzen). Proposed by an atmospheric chemist, incorporated (with caveats) into the geologic deep time of the planet by geologists, and taken up with vigor by humanists, social scientists, and artists, the Anthropocene has, for better or worse, broken significant new ground in Earth-oriented thought.The term’s core proposals—that humans are a geologic force and we have entered a wholly new period of Earth history—has compelled scholars to engage with a geologic tradition of mapping and classifying the history of said forces along a temporal scale. This tradition—exemplified in the International Chronostratigraphic Chart (ICC) below (Figure 1)—relies on the translation of messiness and difference into abstracted orderly categories of strata and type. Of course, no geologist would claim that the ICC is a direct representation of the materiality of the rocky Earth we live on, so full of faults, fissures, and unconformities. But as writers, [End Page 3] artists, and activists have made clear, the repositioning of humans-as-strata is far riskier than imposing abstract order on a cliff face: it dangerously flattens out the messiness of human history and difference—obfuscating the uneven histories of extraction and oppression to which the mining of geophysical energies and resources is so clearly bound. The Anthropocene has therefore helped reveal the immense pitfalls of conflating a species with the geologic, and made clear the need for humanists—both within the academy and beyond—to develop a language and method for thinking about the changing Earth. Contemporary rhetoric around how to conceive of change—backed often by disciplinary boundary-keeping—exemplifies such divisions. Take, for example, the grammatical distinction between political, social forces and physical, environmental forcings (Hulme). These seemingly inane suffixes recast agency and allow the natural and social worlds to exist in two separate spheres (albeit ones that overlap via extraction) where human action is more wholly filled with intent. Breaking this distinction via a reconceptualization of geologic agency underpins [End Page 4] what scholars, including Pratik Chakrabarti and Kathryn Yusoff, have been articulating so clearly: rocks have politics. To unpack this carefully and fully, however, requires moving beyond the collapse of anthropos into geos: there is too much texture, history, and action lost in such a sweeping and simple formulation.This collection takes these problematics of the Anthropocene as self-evident: it critically engages with the chronostratigraphic logic that implicitly upholds a view of time, history, and knowledge which operationalizes the extractive carbon capital economies fueled by colonialism and slavery. This article asks how the application of digital technologies is changing the organization of the agri-food system in the context of the third food regime. The academic debate on digitalization and food largely focuses on the input and farm level. Yet, based on the analysis of 280 digital services and products, we show that digital technologies are now being used along the entire food commodity chain. We argue that digital technologies in the third food regime serve on the one hand (...) as a continuation of established information and communication technologies, thus deepening certain features of the existing food regime such as the retail sector’s control over global commodity chains. On the other hand, digital technologies also introduce new forms of control and value extraction based on the use of data and pave the way for large tech companies to take over market shares in the agri-food sector. Finally, we find that multinational agri-food companies are starting to take on the business models of leading digital tech companies, for instance by developing digital platforms throughout the agri-food system. We argue that this shows that the broader economic restructuring of neoliberal capitalism towards digital capitalism is also making its way into the agri-food system. (shrink)

Conceptual engineering and conceptual ethics are branches of philosophy concerned with questions about how to assess and ameliorate our representational devices (such as concepts and words). It's a part of philosophy concerned with questions about which concepts we should use (and why), how concepts can be improved, when concepts should be abandoned, and how proposals for amelioration can be implemented. Central parts of the history of philosophy have engaged with these issues, but the focus of this volume is on applications (...) to work in contemporary philosophy of language and mind, epistemology, gender and race theory, ethics, philosophy of science, and philosophical logic. This is the first volume devoted entirely to conceptual engineering and conceptual ethics. In recent years, there has been growing discussion amongst philosophers about “conceptual engineering”. Put roughly, conceptual engineering concerns the assessment and improvement of concepts, or of other devices we use in thought and talk (e.g., words). This often involves attempts to modify our existing concepts (or other representational devices), and/or our practices of using them. This paper explores the relation between conceptual engineering and conceptual ethics, where conceptual ethics is taken to encompass normative and evaluative questions about concepts, words, and (...) other broadly “representational” and/or “inferential” devices we use in thought and talk. We take some of the central questions in conceptual ethics to concern which concepts we should use and what words should mean, and why. We put forward a view of conceptual engineering in terms of the following three activities: conceptual ethics, conceptual innovation, and conceptual implementation. On our view, conceptual engineering can be defined in terms of these three activities, but not in a straightforward, Boolean way. Conceptual engineering, we argue, is made up of mereologically complex activities whose parts fall into the categories associated with each of these three different activities. (shrink)

Given the variety of roles psychologists can choose to engage on social media, it is imperative that guidelines are established. Questions about the nature of the relationship between language and extralinguistic cognition are old, but only recently has a new view emerged that allows for the systematic investigation of claims about linguistic structure, based on how it is understood or utilized outside of the language system. Our paper represents a case study for this interaction in the domain of event semantics. We adopt a transparency thesis about the relationship between linguistic structure and extralinguistic cognition, investigating whether different lexico-syntactic structures can (...) differentially recruit the visual causal percept. A prominent analysis of causative verbs like move suggests reference to two distinct events and a causal relationship between them, whereas non-causative verbs like push do not so refer. In our study, we present English speakers with simple scenes that either do or do not support the perception of a causal link, and manipulate (between subjects) a one-sentence instruction for the evaluation of the scene. Preliminary results suggest that competent speakers of English are more likely to judge causative constructions than non-causative constructions as true of a scene where causal features are present in the scene. Implications for a new approach to the investigation of linguistic meanings and future directions are discussed. (shrink)

This book reimagines the compositional semantics of comparative sentences using words such as more, as, too, and others. The book's central thesis entails a rejection of a fundamental assumption of degree semantic frameworks: that gradable adjectives like tall lexicalize functions from individuals to degrees, i.e., measure functions. I argue that comparative expressions in English themselves introduce “measure functions”; this is the case whether that morphology targets adjectives, as in *taller* or *more intelligent*; nouns, as in *more coffee*, *more coffees*; verbs, (...) such as *run more*, *jump more*; or expressions of other categories. Furthermore, she suggests that expressions that comfortably and meaningfully appear in the comparative form should be distinguished from those that do not in terms of a general notion of "measurability": a measurable predicate has a domain of application with non-trivial structure. This notion unifies the independently motivated distinctions between, for example, gradable and non-gradable adjectives, mass and count nouns, singular and plural noun phrases, and telic and atelic verb phrases. Based on careful examination of the distribution of dimensions for comparison within the class of measurable predicates, I tie the selection of measure functions to the specific nature and structure of the domain entities targeted for measurement. The book ultimately explores how, precisely, we should understand semantic theories that invoke the "nature" of domain entities: does the theory depend for its explanation on features of metaphysical reality, or something else? Such questions are especially pertinent in light of a growing body of research in cognitive science exploring the understanding and acquisition of comparative sentences. (shrink)

The menopause transition is associated with an increased risk of depressed mood. Preliminary evidence suggests that increased sensitivity to psychosocial stress, triggered by exaggerated perimenopausal estradiol fluctuation, may play a role. However, accurately quantifying estradiol fluctuation while minimizing participant burden has posed a methodological challenge in the field. The current pilot project aimed to test the feasibility of capturing perimenopausal estradiol fluctuation via 12 weekly measurements of estrone-3-glucuronide (E1G), a urinary metabolite of estradiol, using participant-collected urine samples in 15 euthymic (...) perimenopausal women ages 45-55 years. Furthermore, it aimed to correlate E1G fluctuation (standard deviation across the 12 E1G measurements) with weekly mood and cardiovascular, salivary cortisol, and subjective emotional responses to the Trier Social Stress Test (TSST) at weeks 4, 8 and 12. Protocol acceptability and adherence was high; furthermore, E1G fluctuation was positively associated with anhedonic depressive symptoms and weekly negative affect. E1G fluctuation was also associated with increased heart rate throughout the TSST as well as higher levels of rejection, anger, and sadness. E1G fluctuation was not significantly associated with TSST blood pressure or cortisol levels. This study suggests a feasible method of assessing estradiol fluctuation in the menopause transition and provides support for the hypothesis that perimenopausal estradiol fluctuation increases sensitivity to psychosocial stress and vulnerability to depressed mood. Autobiographical memory specificity has been associated with cognitive function, depression, and independence in older adults. This longitudinal study of 162 older adults moving to active supported living environments tracks changes in the role of the ability to recall specific autobiographical memory as a mediator between underlying cognitive function, or depression, and outcome perceived health or independence, across 18 months, as compared with controls not moving home. Clear improvements across time in autobiographical specificity were seen for residents but not controls, supporting (...) the role of a socially active environment, and confirmed by correlation with number of activities reported in diaries, although the impact of diary activities on the effect of time on autobiographical specificity was not found. The role of autobiographical specificity in mediating general cognition and outcome functional limitations was clear for social limitations at 12 and 18 months, but its role in mediating effects of executive function and perceived health persisted throughout. The role of specificity in mediating between depression and perceived health, IADLs, and Functional Limitations persisted throughout. Analysis examining autobiographical specificity and depression as joint mediators between cognition and independence showed a forward effect such that higher specificity scores reduced the negative mediation effect of depression on independence. Finally, data showed the reduction of many of these mediations over time, supporting the role of autobiographical memory in times of change in a person's social situation. Robert Alexy develops his influential theory of legal reasoning exploring the nature of legal argumentation and its relation to practical reasoning. In doing so he sheds light on fundamental questions of law and rationality, which are as crucial to practising lawyers and law students as they are to scholars of legal theory.

At the heart of this book is the age-old question of how law and morality are related. The legal positivist, insisting on the separation of the two, explicates the concept of law independently of morality. The author challenges this view, arguing that there are, first, conceptually necessary connections between law and morality and, second, normative reasons for including moral elements in the concept of law. While the conceptual argument alone is too limited to establish a sufficiently strong connection between law (...) and morality, and the normative argument alone fails to address the nature of law, the two arguments together support a nonpositivistic concept of law, toppling legal positivism qua comprehensive theory of law. The present study aimed to translate and identify the psychometric properties of the Behavioral Emotion Regulation Questionnaire in 315 university students from Lima, Peru, aged 16 to 44 years. The BERQ and the Multicultural Inventory of Trait State Depression were administered for the assessment. Evidence of internal structure validity was obtained through confirmatory factor analysis and exploratory structural equation modeling, while evidence of validity in relation to other variables was obtained through linear regression analysis. The results indicate that the pentafactorial (...) structure is replicated in the Peruvian sample; that adaptive strategies significantly predict eutres, and that maladaptive strategies predict distress; in addition, reliability values were acceptable. At the end, theoretical and practical aspects of the findings and the importance of continuing to provide evidence for its use in different populations and contexts are discussed, taking into account that this is the first time that a Spanish version of the BERQ has been analyzed. This paper explores the hypothesis that all comparative sentences— nominal, verbal, and adjectival—contain instances of a single morpheme that compositionally introduces degrees. This morpheme, sometimes pronounced much, semantically contributes a structure-preserving map from entities, events, or states, to their measures along various dimensions. A major goal of the paper is to argue that the differences in dimensionality observed across domains are a consequence of what is measured, as opposed to which expression introduces the measurement. The resulting theory has a number (...) of interesting properties. It characterizes the notion of ‘measurement’ uniformly across comparative constructions, in terms of non-trivial structure preservation. It unifies the distinctions between mass/count nouns and atelic/telic verb phrases with that between gradable and non-gradable adjectives. This paper explores the nature of ourexperiences of values– ourvalueceptions. In the recent literature, two main standpoints have emerged. On the one hand, the ‘Meinongian’ side claims that axiological properties are experienced exclusively in emotions. On the other hand, the ‘Hildebrandian’ side contends that since valueceptions can be ‘cold’, they are not accomplished in emotions but rather reside in ‘value-feelings’ – emotions, in this framework, being conceived of asreactionsto the values thus revealed. The aim of the paper is to argue (...) that theHusserlianphenomenology of affectivity, especially as it is developed during his Göttingen period, can help to overcome these two accounts. I start by pointing out that, contrary to what most scholars have assumed so far, Husserl’s theory of valueception is not tantamount to Meinong’s, as it is very sensitive to ‘Hildebrandian’ arguments (Part 2). The core of the paper is then devoted to a systematic reconstruction of Husserl’s solution to this controversy. Drawing on the analogy between thing-perceptions and value-perceptions (Part 3), I show, first, that ‘cold’ valueceptions are to be identified with empty apprehensions (Auffassungen) of value, in which an emotion is notactually experiencedbut isanticipatedin such-and-such kinaesthetic circumstances (Part 4); second, that the realization of this anticipation amounts to thefulfillmentof the valueception (Part 5). As a result, Husserl acknowledges the relevance of ‘value-feelings’, yet his account appears more satisfactory than traditional ‘Hildebrandian’ theories in that it demystifies these ‘value-feelings’ by reducing them topotential emotions. Philosophical and sociological approaches in technology have increasingly shifted toward describing AI (artificial intelligence) systems as ‘(moral) agents,’ while also attributing ‘agency’ to them. It is only in this way – so their principal argument goes – that the effects of technological components in a complex human-computer interaction can be understood sufficiently in phenomenological-descriptive and ethical-normative respects. By contrast, this article aims to demonstrate that an explanatory model only achieves a descriptively and normatively satisfactory result if the concepts of ‘(moral) (...) agent’ and ‘(moral) agency’ are exclusively related to human agents. Initially, the division between symbolic and sub-symbolic AI, the black box character of (deep) machine learning, and the complex relationship network in the provision and application of machine learning are outlined. Next, the ontological and action-theoretical basic assumptions of an ‘agency’ attribution regarding both the current teleology-naturalism debate and the explanatory model of actor network theory are examined. On this basis, the technical-philosophical approaches of Luciano Floridi, Deborah G. Johnson, and Peter-Paul Verbeek will all be critically discussed. Despite their different approaches, they tend to fully integrate computational behavior into their concept of ‘(moral) agency.’ By contrast, this essay recommends distinguishing conceptually between the different entities, causalities, and relationships in a human-computer interaction, arguing that this is the only way to do justice to both human responsibility and the moral significance and causality of computational behavior. Before engaging with intentionality, the philosopher of mind must consider the intrinsic nature of psychological elements. Conscious states, contrary to ordinary and scientific objects, seem to penetrate each another in such a way that it becomes impossible to enumerate, class or organize through laws the various experiences at stake. In this context, how is a science of consciousness conceivable? How is it possible to apply the epistemological requirements of any science to a domain whose ontological nature contradicts such demands? The (...) paper reconstructs Husserl’s solution to this issue in the Fifth Logical Investigation. I show how his appeal to the mereological framework of the Third Investigation gives him the tools to rationalize the domain of the mind and to establish phenomenology as an authentic science of consciousness. I first demonstrate that the very task of phenomenological investigations is defined in mereological terms. I then reconstruct the issue regarding the inclusion of the intentional object within the act, by exposing the nuances of the Husserlian position in this famous controversy. In a last part, I show how mereological concepts are at the core of the Husserlian reinterpretation of the Brentanian thesis according to which all acts are presentations or based on presentations. Are White, All the Blacks Are Men, But Some of Us Are Brave: Black Women's Studies, I imagined a wealth of examples of the world and the work made possible by these two groundbreaking anthologies. I wondered what their editors and contributors were writing now. I wondered about the work of their students and people like me: those of us who understand everything we write as indebted to the path-making, silence-clearing, generative, and bodacious work of the participants in the miracles that are This Bridge Called My Back and But Some of Us Are Brave.But today as I reread the contributions that actually emerged from this process, I realize that my dream was too small. I imagined writing that would provide evidence of the ongoing impact made by these two anthologies. Instead, the creative writing in this special issue offers something more crucial and beautiful than I had imagined. These works are not mere evidence of a transformed world; these works are continuing to transform the world in urgent and visionary ways. As repeated again and again by participants in the 2022 celebration for the fortieth anniversary celebration of This Bridge Called My Back, the work that inspired these anthologies is not over. The writings featured in this issue not only show [End Page 198] how this work continues, but they feed, nurture, and provoke us as we honor our responsibility to transform this world.For example, when Akasha Gloria Hull, coeditor of But Some of Us Are Brave, shares her daily early morning meditative writing in "Writing and Rebirth: A Set of Journal Poems," we remember not only her fundamental work excavating the daily lives of Black women writers from the nineteenth century—most notably in Give Us Each Day, her edited book based on the diaries of poet Alice Dunbar Nelson—but also our own imperative. Hull's reflections on health challenges, interpersonal conflict, resurrection, collaboration, and writing itself remind us that our feminist praxis is impactful because of its dailyness. Those of us who wake up tomorrow will need to ask the same critical questions the editors of But Some of Us Are Brave asked of the fields of Black studies and women's studies. We will find surprises and repetitions in the days we meet, and then we will have to do it again.When we read two new prose poems by Cheryl Clarke, an original contributor to This Bridge Called My Back, we have an opportunity to time travel. In "Living as a Lesbian in the Archive of Style," we venture into a critical engagement with the term "hardcore lesbian," displacing the desires of the person who needs to classify others using that term with those of someone who has been hailed by it. Clarke's poem is a reminder that as we work in literary traditions and fields of study made possible by the revolutionary identity politics of an earlier era, we are still responsible for centering the experiences of those most impacted by our fluent and fluid naming practices. In "History," Clarke offers us a timely Black lesbian feminist lens on many iterations of responding to police violence, centering the perspective of a lesbian, her lover, and her lover's husband.The poem "On Being an hbcu Graduate, Teacher, Professor-Scholar at Stillman College, Tuscaloosa, AL, in May 2015" by doris diosa davenport—an original contributor to But Some of Us Are Brave—highlights the intimacy, hilarity, and poignancy of the daily work of intergenerational critical and creative praxis. In particular, she considers the context of institutions and regions that are sometimes excluded from the imaginary of how and where feminist work happens. davenport transmits the lessons and energy gained through her practice of thinking and gathering otherwise... Metasemantics comprises new work on the philosophical foundations of linguistic semantics, by a diverse group of established and emerging experts in the philosophy of language, metaphysics, and the theory of content. The science of semantics aspires to systematically specify the meanings of linguistic expressions in context. The paradigmatic metasemantic question is accordingly: what more basic or fundamental features of the world metaphysically determine these semantic facts? Efforts to answer this question inevitably raise others, including: where are the boundaries of semantics?; (...) what is the essence of the meaning relation?; which framework should we use for semantic theorizing?; and what are the intrinsic natures of semantic values? Metasemantic inquiry has long been recognized as a central part of the philosophy of language, but recent developments in metaphysics and semantics itself now allow us to approach these classic questions with an unprecedented degree of precision. In this article the author adduces a non‐positivist argument for a necessary connection between law and morality; the argument is based on the claim to correctness, and it is directed to an attack stemming from Eugenio Bulygin. The heart of the controversy is the claim to correctness. The author first attempts to show that there are good reasons for maintaining that law necessarily raises a claim to correctness. Digital records, from chat transcripts to social media posts, are being used to create chatbots that recreate the conversational style of deceased individuals. Some maintain that this is merely a new form of digital memorial, while others argue that they pose a variety of moral hazards. To resolve this, I turn to classical Chinese philosophy to make use of a debate over the ethics of funerals and mourning. This ancient argument includes much of interest for the contemporary issue at hand, (...) including the use of impersonators of the dead to help the bereaved to deal well with their grief. I connect this historical discussion with a modern trend in clinical psychology that reframes therapeutic interventions with bereaved individuals. The trend directs practitioners away from facilitating detachment and toward affirming continuing bonds. I conclude that these chatbots can offer an important source of support to mourners, but also discuss parameters and features of social context that will be important to avoid the moral hazards identified by sceptics. This paper answers several open questions around structures with o‐minimal open core. We construct an expansion of an o‐minimal structure by a unary predicate such that its open core is a proper o‐minimal expansion of. We give an example of a structure that has an o‐minimal open core and the exchange property, yet defines a function whose graph is dense. Finally, we produce an example of a structure that has an o‐minimal open core and definable Skolem functions, but is not (...) o‐minimal. (shrink)

The article begins with an outline of the balancing construction as developed by the German Federal Constitutional court since the Lüth decision in 1958. It then takes up two objections to this approach raised by Jürgen Habermas. The first maintains that balancing is both irrational and a danger for rights, depriving them of their normative power. The second is that balancing takes one out of the realm of right and wrong, correctness and incorrectness, and justification, and, thus, out of the (...) realm of the law. The article attempts to counter these objections by showing that there exists a rational structure of balancing that can be made explicit by a “Law of Balancing” and a “Disproportionality Rule.” These rules show, first, that balancing is not a danger for rights but, on the contrary, a necessary means of lending them protection, and second, that balancing is not an alternative to argumentation but an indispensable form of rational practical discourse. I defend social media’s potential to support Aristotelian virtue friendship against a variety of objections. I begin with Aristotle’s claim that the foundation of the best friendships is a shared life. Friends share the distinctively human and valuable components of their lives, especially reasoning together by sharing conversation and thoughts, and communal engagement in valued activities. Although some have charged that shared living is not possible between friends who interact through digital social media, I argue that social media preserves the (...) relevantly human and valuable portions of life, especially reasoning, play, and exchange of ideas. I then consider several criticisms of social media’s potential to host friendships, and refute or weaken the force of these objections, using this conception of a distinctively human shared life. I conclude that we should use the shared life to evaluate features of specific social media and norms for users’ conduct. (shrink)

In the first part of the paper we study arithmetical properties of Pascal triangles modulo a prime power; the main result is the generalization of Lucas' theorem. Then we investigate the structure N; Bpx, where p is a prime, α is an integer greater than one, and Bpx = Rem, px); it is shown that addition is first-order definable in this structure, and that its elementary theory is decidable.

Suppose our ordinary notion of truth is ‘inconsistent’ in the sense that its meaning is partly given by principles that classically entail a logical contradiction. Should we replace the notion with a consistent surrogate? This paper begins by defusing various arguments in favor of this revisionary proposal, including Kevin Scharp’s contention that we need to replace truth for the purposes of semantic theorizing . Borrowing a certain conservative metasemantic principle from Matti Eklund, the article goes on to build a positive (...) case for the opposite policy: retaining truth as-is. The thought is basically that bivalence for the bulk of what we say in the course of ordinary, scientific, and philosophical inquiry should suffice to justify keeping ‘true’. Contemporary discussions about practical reason or practical rationality invoke four competing views which can be named as follows by reference to their historical models: Aristotelian, Hobbesian, Kantian and Nietzschean. The subject-matter of this article is a defence of the Kantian conception of practical rationality in the interpretation of discourse theory. At the heart, lies the justification and the application of the rules of discourse. An argument consisting of three parts is pre sented to justify the rules of discourse. The three (...) parts are as follows: a transcen dental-pragmatic argument; an argument which takes account of the maximisation of individual utility and an empirical premise about an interest in correctness. Within the framework of the problem of application, the article outlines a justification of human rights and of the basic institutions of the democratic constitutional state on the basis of discourse theory. La crise écologique que nous traversons actuellement invite à reconsidérer la place de l’espèce humaine dans le monde vivant. Si la civilisation humaine repose de plus en plus sur un développement sans précédent de la technique, elle est confrontée aux impasses d’un interventionnisme technique incapable de résoudre les problèmes proprement biologiques et écologiques. À l’encontre d’une conception unilatérale de notre relation à l’égard des autres espèces, largement centrée sur la domination et l’exploitation, cette crise conduit à approfondir la notion d’ambivalence (...) anthropologique. si l’accès à un univers de sens et de valeur, rendu possible par la complexification de notre système nerveux et ainsi de notre psychisme, nous met à distance de la nature et du reste de la vie organique, nous sommes cependant le fruit d’une histoire naturelle qui nous dépasse et restons profondément dépendants des autres vivants. Notre ambition dans cet article est de creuser cette ambivalence à partir d’une interrogation sur l’histoire et, plus précisément, sur le rapport entre histoire humaine et histoire naturelle. ce point de vue historique, nous l’héritons des réflexions de Bergson et de Ruyer qui nous amènent à défendre, sans contradiction, les deux thèses suivantes. si, d’une part, l’inclusion de l’histoire humaine dans l’histoire évolutive doit nous conduire à prendre en compte notre profonde continuité et dépendance à l’égard du vivant, notamment dans les solutions que nous pouvons apporter à la crise actuelle, elle doit d’autre part nous inviter à envisager la spécificité humaine d’un retour collectif et critique sur nos pratiques dans la biosphère, retour qui pourrait changer le cours de l’histoire que nous construisons en commun avec le reste du monde vivant. cela nous conduira à révéler et critiquer les présupposés théoriques et pratiques des solutions généralement envisagées pour faire face à l’urgence de la crise écologique et à souligner, en contrepartie, l’utilité des collaborations interspécifiques pour relancer des dynamiques évolutives que notre technique peut accompagner mais jamais remplacer. The argument of this article is that the dual-nature thesis is not only capable of solving the problem of legal positivism, but also addresses all fundamental questions of law. Examples are the relation between deliberative democracy and democracy qua decision-making procedure along the lines of the majority principle, the connection between human rights as moral rights and constitutional rights as positive rights, the relation between constitutional review qua ideal representation of the people and parliamentary legislation, the commitment of legal argumentation (...) to both authoritative and non-authoritative reasons, and the distinction between rules as expressing a real “ought” and principles as expressing its ideal counterpart. All of this underscores the point that the dual nature of law is the single most essential feature of law. (shrink)

The status and functioning of shame is contested in moral psychology. In much of anglophone philosophy and psychology, it is presumed to be largely destructive, while in Confucian philosophy and many East Asian communities, it is positively associated with moral development. Recent work in human-robot interaction offers a unique opportunity to investigate how shame functions while controlling for confounding variables of interpersonal interaction. One research program suggests a Confucian strategy for using robots to rebuke participants, but results from experiments with (...) educational technologies imply a different and potentially opposing account of shame’s role in personal development. By digging deeper into the details of Confucian theorizing about shame, I identify a unifying explanation for these apparently conflicting results. I conclude by offering suggestions for future empirical research in human-robot interactions to further investigate shame’s role in moral development. (shrink)
